What data do we collect ?

In order to provide the subscribed service, Mistral Informatique, responsible for processing, located at 39, rue Georges Besse, 63100 Clermont-Ferrand (France), collects and processes the following personal data: Name, first name, email address, telephone number, position, company. These personal data are processed by Mistral Informatique for management and information purposes only.

Moreover, we collect data to improve the services offered to Mistral users. If you use MisTab published by Mistral, you will provide us with information relating to the geographical position of the mobile device (tablet or phone) that you are using.

How do we collect data ?

Your location can be determined with varying degrees of accuracy using your mobile device’s GPS or information about things near your device, such as Wi-Fi hotspots, cell towers, and radio stations. devices with Bluetooth enabled.

After having informed you of the collection of information relating to the GPS coordinates of the tablet or smartphone, and once you have authorized us to do so, the collection is done in the background, even if the application is not in use, in order to make the geolocation more reliable and to avoid you having to constantly report your position. The collection in the background does not affect the normal operation of the device. At any time, you can deactivate this collection.

What do we do with your data?

This app collects only location data to enable itinerary  calculation, planning of sales trips, planning of technicians’ interventions,  transport management even when the app is closed or not in use.

The consultation, collection, use  of this data is strictly limited to this use. Your data is not rented, sold or communicated to third parties outside your company. Of course, if the user has disabled the collection of GPS coordinates, neither he nor other Mistral users will benefit from these features.

How long do we keep your data?

After three months, the data is permanently deleted from the Mistral ERP.

CONDITIONS OF USE

These are the Terms of Service of MisDM (“App” or “application”) with the packages « MobiTec”, “MobiDrive”, “MobiVip”, « MobiStac », « MobiTrans » and « MisNot », developed Mistral Informatique (“The Publishers”).

We provide the following features in our Application : itinerary  calculation, planning of sales trips, planning of technicians’ interventions,  transport management.

1. Terms

By using the app, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the app. The materials contained inside the app are protected by applicable copyright and trademark law.

2. Use License

a. This is the grant of a license, not a transfer of title, and under this license you may not:
i. disabling or circumvention of any access control, security or privacy mechanism of the app or any SDK or library included.
ii. further distribution of the SDK or libraries included.
iv. attempt to decompile or reverse engineer any software contained on The Publishers application and SDKs or libraries included;
v. remove any copyright or other proprietary notations from the App;
vi. transfer the content to another person or « mirror » on any other server.

b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by The Publishers at any time. Upon the termination of this license, you must destroy any downloaded copy in your possession.

3. Disclaimer

The contents on The Publishers’s App are provided « as is ». The publishers make no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, The Publishers do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the content on its app, website or otherwise relating to such materials or on any sites linked to them. Either the publisher or the third parties will provide any kind of warranty on the data showed in the app. The user must use it assuming the risk.

4. Limitations

In no event shall The Publishers or its third parties be liable for any damages (including, without limitation, damages for loss of data or profit, fines, law caused damages, or due to business interruption,) arising out of the use or inability to use the The Publisher’s App, even if The Publishers or a The Publishers authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. Neither The Publishers nor third parties are liable for any kind of damage caused by the app behavior or app’s content, even if this damage is caused by an incorrect behavior of the application.

5. Revisions and Errata

The Publishers does not warrant that any of the materials on application are accurate, complete, or current. The Publishers may make changes to the content contained on its app at any time without notice. The Publishers does not, however, make any commitment to update the contents or databases.

6.Site Terms of Use Modifications

The Publishers may revise these terms of use for the Application at any time without notice. By using the Application you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

7. Governing Law

Any claim relating to The Publishers’s App shall be governed by the laws of the State of France without regard to its conflict of law provisions. General Terms and Conditions applicable to Use of a Application.
